SALES POST for goodness :D

  THE CAUSE + CONDITIONS
1. a close friend of mine, [livejournal.com profile] viewpoints, is a freelance photographer just starting out; her current homepage is here if you want to check it out!
2. the world being full of suck, family + money troubles = epic fail. con season isn't quite in kick yet, and so she's in a bit of a pinch as she tries to start up on her feet
3. in an effort to try and help out, I'm selling off a few thing sitting around my room. :D

Tea-qualifier: all my teas are loose leaf, and good! :D I've got green tea from Japan in one or two varieties (genmaicha and sencha, I think), chai, vanilla (black), irish breakfast, a lot of earl greys (some English, some American). Tea-bag wise I have fruit teas!

I've seen it happen a lot lately, e.g. livelong&marry and other stuff. So you could work around it by saying that you're paying for time, not for the story itself? I don't know the legalities. :x

In the case of livelong I think the case is that it's for charity, i.e not for profit, whereas in this case it is for the profit of my friend?

I know that's it's for charity, but I'm wondering if it still involves paying. Like the sweet charity fandom auction thing? I've seen some people doing auctions where you bid on them and they'll write whatever you want afterwards, etc., so you're actually paying. ( I don't know if that was sweet charity, but I know I've seen it around LJ before. ) Which I am totally 120% absolutely fine with, but I think that might be stepping over the line. ( however, if it isn't stepping over the line for whatever legal reason, then you can use the exact same loophole for offering fic in exchange for donations for your friend. :D )

perhaps I should add that ultimately the money does go to the charity, so perhaps that's the loophole - you're paying directly to the charity but "paying" for some author's service? Ahhhmmm. Confusion.

Well, in cases where you're "paying" for charity - it's kind of like, no money is made from the use of other people's IP? The charity is the only one who is paid any physical amount? :D?

Yeaaaa, I think I got it wrong the first time re: charities. The idea behind that is some author offers his/her skillz. People bid on him/her until some arbitrary time goes by, at which point the winner donates whatever amount of money they have to XYZ charity, and the author writes the winner some story. ( but I suspect you knew this since you were involved in SC, right? Is that how it worked? )

But, I've also seen cases where privately, without any kind of charity involved, people will offer fic for "money", i.e. they offer up their skillz, people offer them money, and the author ends up sending the person a small gift or postcard or something entirely legal to pay money for, so if the Feds come knocking the argument is that the payee was paying for the item, and the fic was just the icing.

However, I don't think you need to get that elaborate. I think most of the issues with copyright are associated with people trying to sell their fic to publishers or zines, etc.

Nope, nope, I totally get it. :D

SC works that way, yep, and I think avoids all the legal loopholes by doing that. The second case is what I think there's been more ??? and crackdown over, but there are ways around it - like the postcard thing, or a Write it Original but Hey Search Replace The Names thing. \o

The zine thing is probably the only thing that anyone would take action for because of distribution, I think -- there are clauses in most laws saying that if so-and-so's actions don't affect a significant blah blah of the company's profit, then legal action is limited &c &c. GOOD FOR US.

I'm all for things like SC and livelong, so hurray for them avoiding legalities. Plus, honestly, if someone attempted to file a lawsuit against them it would just look bad. ( do people actually do "write original, then search&replace"? That's kind of brilliant. )

Yea, the zine/legal publication thing is what most lawsuits are after. Yay for fan-created things that are free and therefore mostly legal.

Pfft, I can't write original to save my life, unless it's "original". I just don't have the incentive. I don't fall in love with my own characters as readily as other people's. I've occasionally written things where I have to work with extremely minor characters, so much so that the only thing not original about it is the name. So I guess I kind of trick myself into writing original things. *g*

No kidding! That's what I didn't understand about the entire millenium fiasco some years ago, where they shut down fanwebsites and sued some people and everyone was slinging mud. They just lost a whole bunch of fans, why would they do that? Stupid.

I can't really write original myself, until sometimes I look at the stuff that I do write and realise that search-replace works the other way around too. But usually motivation goes kaplaaaaaaaat, and nothing happens. MAGICARP USES SPLASH.
